BombReel Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your access to and use of the BombReel mobile application, related websites and services (collectively, the "Service"). These Terms form an agreement between you and the operator of BombReel ("BombReel", "we", "us" or "our"). By creating an account, accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility and Young Users

BombReel is currently intended for users aged 13 and above. Users below 13 must not create an account or use the Service unless and until BombReel implements a lawful parental or guardian consent process.

If you are below the age at which you can enter into these Terms on your own in your jurisdiction, you may use BombReel only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

3. Accounts and Security

You are responsible for providing accurate information where required, keeping your account credentials and device secure, and for activity carried out through your account unless caused by BombReel's breach of its legal obligations.

You must notify us promptly at bombreelhq@gmail.com if you reasonably believe your account has been compromised or used without authorisation.

4. What BombReel Does

BombReel enables users to record or upload media, create and edit short event reels, save or remove reels, and share reels to supported third-party platforms. Features may change as the Service develops.

Some features may be provided in beta, test or preview form. Such features may be changed, suspended or removed while they are being developed.

5. Your Content

You retain ownership of content that you create and upload to BombReel, subject to any rights held by other people appearing in or contributing to that content.

You grant BombReel a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transcode, display, reproduce and otherwise use your content only to operate, secure, improve and provide the Service, to perform actions you request, and to comply with applicable law. This licence ends when the content is deleted from our systems, except to the extent that retention is reasonably necessary for legal, security, backup, dispute-resolution or other lawful purposes, or where the content remains part of a shared event experience under the functionality described to you.

6. Recording Other People and Event Rules

Photos, video and audio may identify other people. You are responsible for using BombReel in a lawful and respectful manner. You must not intentionally record, upload or share content where you know that doing so is unlawful, violates another person's rights, or breaches binding venue, festival or event rules.

Where consent, permission or another lawful basis is required for the recording, upload or disclosure of another person's personal data, image, voice, performance or other protected material, you are responsible for obtaining it before using BombReel for that purpose.

BombReel may review and respond to credible privacy, safety, intellectual-property or removal complaints concerning user content.

7. Sharing to TikTok and Other Third-Party Platforms

When you choose to share content to TikTok, Instagram, YouTube, WhatsApp or another third-party platform, the third party's own terms, community rules, technical requirements and privacy policy apply to your use of that platform.

BombReel does not control whether a third-party platform accepts, publishes, removes, restricts, monetises or otherwise handles your content. A platform-specific sharing integration may open or transfer content to the selected platform, but you remain responsible for completing any posting steps required by that platform.

You must not use BombReel to bypass third-party platform restrictions, copyright controls, access controls or other technical or legal safeguards.

8. Prohibited Uses and Content

You must not use the Service to create, upload, share, promote or facilitate content or activity that is unlawful; fraudulent; defamatory; threatening; harassing; exploitative; sexually abusive; hateful; violent in an unlawful manner; invasive of privacy; infringing of intellectual property; malicious; designed to distribute malware; or otherwise prohibited by applicable law.

You must not attempt to gain unauthorised access to BombReel, interfere with the Service, scrape or harvest data in an unauthorised manner, reverse engineer the Service except where the law expressly permits it, impersonate another person, or misuse another person's account or personal data.

9. Intellectual Property in BombReel

BombReel and its software, interface, branding, logos, graphics, designs, text and other materials supplied by BombReel are owned by or licensed to BombReel and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.

You may use the Service only for its intended functionality and in accordance with these Terms.

10. Copyright and Other Rights Complaints

If you believe content available through BombReel infringes your copyright, trade mark, privacy, publicity or other legal rights, contact bombreelhq@gmail.com with enough information for us to understand the complaint, identify the content and contact you.

We may remove or restrict content while we investigate a credible complaint, where reasonably necessary to comply with law, protect users or protect the Service.

11. Privacy and Personal Data

BombReel handles personal data in accordance with its Privacy Policy and applicable law, including Singapore's Personal Data Protection Act 2012 where applicable. The Privacy Policy forms part of the information governing your use of the Service and is available at the public privacy-policy page linked from BombReel's website and app.

12. Removal, Retention and Recently Removed

BombReel may provide a Recently Removed feature that allows certain user-state information or content to be restored for a limited period. Removing a reel from your personal view does not necessarily delete underlying media immediately, particularly where it has been shared, forms part of a shared event experience, is required for security or dispute handling, or must be retained for another lawful purpose.

BombReel will stop retaining personal data when it is no longer needed for a business or legal purpose, subject to applicable law and the Privacy Policy.

13. Suspension and Termination

You may stop using BombReel at any time. Where account-deletion functionality is not yet available in-app, you may contact bombreelhq@gmail.com to request account closure or deletion of eligible personal data.

BombReel may suspend or restrict access where reasonably necessary to protect users, comply with law, investigate suspected misuse, enforce these Terms, respond to security risks, or protect the integrity of the Service. Where appropriate and lawful, we will provide notice or an opportunity to resolve the issue.

14. Availability and Changes to the Service

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability. The Service may be unavailable because of maintenance, connectivity, device limitations, third-party services, security incidents or other circumstances.

We may change, add or remove features as BombReel develops. If a change materially affects users' legal rights or how we handle personal data, we will provide any notice or obtain any consent required by law.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as available" basis. BombReel does not promise that every device, event, venue, network, social platform or third-party integration will always work with the Service.

Nothing in these Terms excludes any warranty, condition, right or remedy that cannot lawfully be excluded under applicable law.

16. Limitation of Liability

To the maximum extent permitted by law, BombReel will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable and that arises from use of or inability to use the Service, third-party platforms, or content supplied by users.

Nothing in these Terms limits or excludes liability to the extent that doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection or other mandatory law.

17. Your Responsibility for Breaches

You are responsible for losses or claims resulting from your unlawful use of BombReel, your infringement of another person's rights, or your material breach of these Terms, to the extent permitted by applicable law. BombReel will take reasonable steps to mitigate avoidable loss.

18. Third-Party Services

BombReel may depend on third-party services such as cloud infrastructure, authentication providers and social platforms. Those services may have separate terms. BombReel is not responsible for independent acts or omissions of third parties that are outside BombReel's reasonable control, but this does not reduce any responsibility BombReel has under applicable law for service providers processing personal data on its behalf.

19. Paid Features and Promotions

BombReel may introduce paid features, advertising, sponsorships, promotions or other monetisation in the future. If we do, additional terms, prices, eligibility rules or disclosures may apply before you use or purchase those features.

20. Changes to these Terms

We may update these Terms as the Service, law or our business changes. We will publish the updated Terms and revise the effective date. If a change materially affects your rights, we will provide reasonable notice where required or appropriate. Continued use after the effective date of an updated version constitutes acceptance only to the extent permitted by law.

21. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without prejudice to any mandatory rights you may have under the laws of another jurisdiction that cannot lawfully be excluded.

If a dispute arises, please contact us first at bombreelhq@gmail.com so that we can try to resolve it. Subject to any mandatory rights or procedures that apply, the courts of Singapore will have jurisdiction over disputes relating to these Terms.

22. General

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision immediately does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent where consent is lawfully required. BombReel may transfer these Terms to a successor operating entity in connection with an incorporation, restructuring, merger, acquisition or transfer of the Service, subject to applicable law and appropriate notice where required.
